Terms and Conditions of Sale

These Terms and Conditions govern purchases made through besahuarts.com. Please read them, the relevant product description, the Shipping & Delivery Policy and the Returns, Refunds & Right of Withdrawal Policy before ordering.

1. Seller

The seller is Bhawana Sahu, a self-employed sole trader (autónoma) in Spain, trading as BeSahu Arts.

2. Scope and customer eligibility

These terms apply to sales made through this website. A consumer is a natural person acting mainly outside a trade, business, craft or profession. If you buy for business purposes, mandatory consumer protections may not apply.

You must be at least 18 years old and legally able to enter a binding contract. You are responsible for providing accurate order, payment and delivery information.

3. Artwork and product information

We take reasonable care to describe each item accurately. The product page states, as applicable, whether the item is an original, edition or reproduction; its medium, support, dimensions, framing status and what is included.

Unless a product page expressly says otherwise, artwork is supplied unframed and decorative props shown in photographs are not included.

Original and handmade work may contain paper texture, deckled edges, brushwork, plate marks or other individual characteristics visible or disclosed in the listing. Screen and lighting settings may cause minor colour differences. These points do not permit a material misdescription.

Dimensions should be checked before ordering. The buyer is responsible for deciding whether an item is suitable for the intended display location and frame, subject to mandatory legal rights.

4. Prices, taxes and delivery charges

Prices are shown in the currency displayed on the website. Applicable taxes collected by BeSahu Arts are included or shown before payment as required by law. Delivery charges and any other unavoidable charge payable to BeSahu Arts are shown before you place the order.

For deliveries outside the relevant customs territory, import VAT, customs duties, carrier handling charges or local taxes may be collected by the destination authority or carrier unless checkout expressly states they are included. The buyer is responsible for such destination charges where the law permits.

If a price or product description contains an obvious error, we may reject or cancel the affected order and refund any amount paid. We will not substitute another artwork without your agreement.

5. Placing an order and contract formation

By submitting an order, you offer to buy the selected item under these terms. An automated acknowledgement confirms that the order was received; it does not by itself guarantee acceptance or availability.

The contract is formed when BeSahu Arts sends written confirmation accepting the order or confirms dispatch, whichever occurs first. If we cannot accept an order—for example because a one-of-one work was sold simultaneously elsewhere, payment was not authorised, delivery is unavailable, or an obvious listing error occurred—we will notify you and refund any amount taken without undue delay.

Order acceptance is subject to payment authorisation and lawful fraud, sanctions and identity checks. We may request reasonable information needed to complete such checks.

6. Payment

Available payment methods are shown at checkout and are processed through Shopify and the selected payment provider. You confirm that you are authorised to use the chosen method. BeSahu Arts does not normally receive complete payment-card details.

7. Availability and one-of-one work

Original artworks are normally available in a quantity of one. Adding an item to a basket does not reserve it. If the same item is purchased simultaneously through different channels, the first completed and accepted order will normally take priority. Any later payment for an unavailable item will be refunded; no substitute is promised.

8. Delivery

Delivery destinations, rates and available services are shown at checkout. Ready-made items are normally prepared for dispatch within up to 10 business days. Unless a different period is stated on the product page or expressly agreed, orders will be delivered without undue delay and no later than 30 calendar days after the contract is formed, subject to the rights and exceptions provided by applicable law.

Carrier transit dates are estimates and customs processing may cause delay. The Shipping & Delivery Policy forms part of these terms.

For consumer orders, risk of accidental loss or damage passes when you, or a person nominated by you other than a carrier you independently appointed, takes physical possession. Ownership passes after full payment.

9. Cancellations, returns and refunds

BeSahu Arts does not offer voluntary change-of-mind returns or exchanges. Mandatory cancellation, withdrawal, conformity and other consumer rights remain unaffected.

The applicable conditions, deadlines, exclusions, return costs and refund procedure are stated in the Returns, Refunds and Right of Withdrawal Policy, which forms part of these terms. Where an electronic withdrawal function is legally required, it is available through the Cancel or return an order link in the website footer.

10. Commissions and personalised work

A commission is accepted only when its written specifications, price, payment schedule and estimated completion or delivery period have been agreed. A request or enquiry alone is not an accepted commission.

Where permitted by law, items made to the customer's specifications or clearly personalised are final for change-of-mind purposes. This does not remove rights concerning damage, fault, incorrect supply or failure to meet the agreed specifications.

11. Legal conformity rights; no commercial warranty

Consumers have mandatory rights where goods are not in conformity with the contract. In Spain, the statutory period in which lack of conformity of new goods may become apparent is generally three years from delivery, subject to the law's conditions and exceptions. This is a legal right, not an additional commercial guarantee offered by BeSahu Arts.

Mandatory remedies may include bringing the item into conformity where possible, a proportionate price reduction or termination of the contract in the circumstances set by law. For a unique original, identical replacement may be impossible; this does not remove the remedies that remain legally available.

Rights concerning lack of conformity do not cover deterioration caused after delivery by accident, unsuitable framing, excessive light, heat, moisture, smoke, improper storage, cleaning, handling or other misuse, unless the law provides otherwise.

12. Care and framing

Works on paper should generally be handled with clean, dry hands, kept dry and displayed away from prolonged direct sunlight, heat and high humidity. Any care note is general information rather than a guarantee against natural ageing. Use a qualified framer where appropriate.

13. Copyright and permitted use

Buying a physical artwork transfers ownership of that physical object only. Copyright, image rights and all reproduction, adaptation, distribution, merchandising and commercial-use rights remain with Bhawana Sahu unless a separate written licence expressly states otherwise.

You may display the physical artwork for personal use and resell the lawful physical copy. You may not reproduce, scan, print, mint as an NFT, license, manufacture merchandise from, use commercially, train a commercial model on, or otherwise exploit the image without prior written permission, except where applicable law expressly permits the use.

14. Website content

Website text, images, branding and design are owned by or licensed to BeSahu Arts and are protected by intellectual-property law. You may browse and use the store for lawful personal purchasing. Automated scraping, unauthorised copying, interference with security or fraudulent use is prohibited.

15. Liability

Nothing in these terms excludes or limits liability that cannot legally be excluded, including mandatory consumer rights or liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where applicable.

Subject to the previous paragraph, BeSahu Arts is not responsible for losses that were not reasonably foreseeable when the contract was formed, losses caused by inaccurate information supplied by the customer, or business losses incurred by a person purchasing as a consumer. Any limitation is applied only to the extent permitted by law.

16. Events outside reasonable control

We are not responsible for delay caused by events outside reasonable control, but this does not remove mandatory rights. We will take reasonable steps to reduce the effect and will contact you where the delay materially affects the order. You retain any right to terminate for delay provided by applicable law.

17. Privacy

Personal information is handled as described in the Privacy Policy and Cookie Policy. Shopify hosts the store and processes data to provide commerce services, including enhanced services based on interactions with Shopify and other merchants where Shopify Network Intelligence is enabled.

18. Complaints and dispute resolution

Send complaints to info@besahuarts.com or the postal address in section 1. Include your order number and a clear description. We will respond within the period required by applicable law.

BeSahu Arts is not currently committed or legally bound to use a specific consumer alternative dispute-resolution body. If a dispute remains unresolved, we will provide any information about an appropriate accredited body and our participation that the law requires at that time. The former European Commission Online Dispute Resolution platform closed in 2025 and is not used.

19. Governing law and courts

These terms and contracts with BeSahu Arts are governed by Spanish law. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protections provided by the law of that country where those protections apply. Courts with jurisdiction will be determined by applicable law; these terms do not require a consumer to use a court other than one available under mandatory law.

20. Severability, language and changes

If any provision is invalid or unenforceable, the remaining provisions continue to apply. A failure to enforce a provision immediately is not a waiver.

The English and Spanish versions are intended to have the same meaning. If an inconsistency arises, the Spanish version will guide interpretation to the extent legally permitted, without limiting mandatory consumer rights.

The terms applying to an order are those accepted when the order is placed. We may update these terms for future orders by publishing a revised date.
